Terms of Use and Membership Terms

The contract for website use, membership access, account security and service boundaries.

Important: These policies preserve rights that cannot legally be excluded. They do not make MMIO a clinical or emergency service.

1. The agreement

These Terms of Use and Membership Terms form an agreement between you and My Mind Is Ok trading as My Mind Is Ok (ABN 35903228833) (“MMIO”, “we”, “us” or “our”) when you browse https://mymindisok.com/, create an account, purchase a membership, or use an MMIO product.

The policies linked from these Terms form part of the agreement where they are relevant, including the Privacy Policy, Subscriptions and Refunds Policy, Scope of Service, Acceptable Use Policy and Safety Policy. If a checkout page contains a specific written offer or guarantee, that offer also forms part of the agreement for that purchase.

By completing checkout, you confirm that you have had a reasonable opportunity to read the terms presented at that time. We keep a privacy-minimised record of the policy version and acknowledgement presented at checkout. You should keep your invoice and a copy of the policies that applied when you purchased.

Non-excludable rights come first. These Terms do not exclude, restrict or modify any guarantee, right or remedy that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.

2. Eligibility and authority

  • Consumer memberships are for people aged 18 or older.
  • You must provide accurate account and billing information and be authorised to use the selected payment method.
  • If you purchase for an organisation, you represent that you are authorised to bind that organisation. Consumer memberships must not be converted into workforce, clinical or institutional services without a separate written agreement.
  • MMIO is presently designed for adults. It is not a child-directed service and must not be used to create a health or wellbeing record about a child.

3. What MMIO provides

MMIO provides self-guided digital wellbeing information, structured reflection tools, learning, activities and private browser-based workspaces. Product descriptions identify the access included in each membership level.

MMIO is designed to help a person settle a moment, sort a situation, take a practical action and build repeatable skills. Results vary. Purchasing access does not guarantee a particular emotional, health, relationship, employment or financial outcome.

MMIO may improve, replace or retire a feature where reasonably necessary for safety, security, accessibility, legal compliance, technical reliability or product quality. We will not deliberately remove the central paid value of an active membership without a fair remedy, advance notice where practicable, or another response required by law.

4. Important service boundary

MMIO provides self-guided wellbeing education, structured tools and practical activities. It does not provide diagnosis, treatment, therapy, nursing care, medical advice, crisis monitoring or emergency services.

MMIO is not:

  • an emergency, crisis, suicide-prevention or monitoring service;
  • a medical, psychological, psychiatric, counselling, nursing or allied-health consultation;
  • a diagnostic, assessment, treatment or medication service;
  • a substitute for a qualified professional who knows your circumstances;
  • a service in which a nurse, clinician or employee reads your private tool entries in real time;
  • a promise that a particular exercise is suitable for every body, relationship, environment or condition.

No therapeutic, clinical, nursing-care or fiduciary relationship is created merely by browsing, purchasing or using MMIO. No clinician, nurse or adviser is assigned to review private entries, supervise use or provide individual care.

Use appropriate professional advice for symptoms, diagnoses, medication, treatment, pregnancy, injury, trauma, abuse, coercion, legal problems, finances, work safety or any situation where general self-guided information is insufficient.

5. Safety and urgent help

Do not use MMIO as the place to report an emergency or wait for someone to notice a crisis. The service does not promise to detect words, patterns, inactivity or risk. You remain free to stop an exercise. Where an activity increases distress, pain, dizziness, conflict or danger, stop and choose an appropriate human, clinical or emergency route.

6. Accounts and trusted devices

  • Your consumer account and subscription are personal to the named account holder.
  • Keep your password, login link, verification code and trusted-device access private.
  • Tell us promptly if you suspect unauthorised access.
  • Do not allow another person to enter their sensitive information into your account or browser workspace.
  • Device and session controls reduce casual sharing but cannot prove who is physically operating an approved device.

We may require reasonable identity or account-security checks before changing an email address, releasing account information, restoring access or discussing billing. We will not ask for a password by email.

7. Browser-local work and your responsibility

Many private reflections, tool drafts, saved plans and personal toolkit entries are intentionally stored in your browser rather than silently centralised on MMIO servers. This gives you greater control but creates an important trade-off: browser-local work may not follow you to another device and may be lost if you clear site data, use private browsing, replace a device, uninstall an app, reset a browser or lose access to that browser profile.

Use the available export or print controls for anything you want to preserve. MMIO will not represent browser-local writing as backed up when it is not. We are not responsible for local-data loss caused solely by your device, browser settings or deletion action, except to the extent the loss was caused by a defect or conduct for which the law makes us responsible.

8. Memberships, payment and renewal

Membership prices, included access, billing frequency and the renewal arrangement are shown before purchase. Unless the offer expressly states otherwise, a monthly or annual membership renews automatically at the end of each billing period until cancelled.

Stripe processes payment information. MMIO does not need to receive the full card number. Stripe’s services remain subject to its own terms and privacy practices. Our use of a payment provider does not remove MMIO’s responsibilities as the seller of the membership.

You authorise the recurring charge shown at checkout. If a payment fails, we may retry the payment, ask you to update the payment method, temporarily restrict paid access or end the membership. We will not describe a failed payment as a debt collection threat where the amount is genuinely disputed.

Cancellation, price changes, refunds, duplicate charges and consumer guarantees are addressed in the Subscriptions, Cancellations and Refunds Policy.

9. Trials, promotions and guarantees

A trial, discount or guarantee applies only if it is stated in writing with its duration, eligibility and conditions. We will not rely on hidden conditions. Unless otherwise stated, a promotion cannot be combined with another promotion and does not change later renewal prices that were clearly disclosed.

A voluntary money-back promise is additional to, and does not replace, rights under the Australian Consumer Law.

10. Acceptable use

You must use MMIO lawfully and consistently with the Acceptable Use Policy. You must not share a consumer membership, bypass access controls, scrape or resell content, attack the service, upload malicious code, impersonate another person, use the service to harass someone, or place another person’s confidential or health information into your workspace without authority.

Reasonable personal quotation and use may be allowed by law. Nothing in these Terms takes away statutory rights such as fair dealing.

11. Suspension and termination

We may temporarily restrict or suspend access where reasonably necessary to investigate security, payment, account-sharing, unlawful use, safety, platform integrity or a material breach. Where circumstances permit, we will explain the concern and give the account holder a reasonable opportunity to respond or secure the account.

Immediate restriction may be necessary where delay would create material security, legal or safety risk. We will not use a broad termination clause to avoid providing a remedy required by law.

Repeated or deliberate material account sharing may lead to cancellation. Cancellation for misuse does not automatically create a discretionary partial-period refund, but it does not remove non-excludable rights or a remedy required because MMIO failed to provide the service with due care and skill.

You may stop using free services at any time and cancel a paid membership through the available account or billing controls.

12. Availability, security and changes

We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Maintenance, internet failures, browser compatibility, third-party providers, security events and events beyond reasonable control can interrupt access.

We use reasonable safeguards and release testing, but no internet system can be guaranteed completely secure. You should use a supported browser, install security updates and protect access to your device and email account.

Material changes to these Terms will be communicated reasonably before they take effect where practicable. We will not use a variation clause to impose a materially different bargain retrospectively. Continued use after a properly notified prospective change may constitute acceptance, but rights that already accrued are preserved.

13. Third-party services and links

MMIO may link to emergency services, public health information, payment providers or other independent services. A link is not a guarantee of availability, suitability or endorsement. Third parties control their own content, security and privacy practices.

Where MMIO chooses and integrates a supplier, we remain responsible for obligations that the law places on us. We do not attempt to shift all supplier failure onto the customer.

14. Intellectual property and member writing

MMIO software, product design, text, illustrations, exercises and brand elements are owned by or licensed to MMIO. A paid membership gives you a limited, personal, non-exclusive, non-transferable right to use the included materials during the access period. It does not transfer ownership or permit commercial reproduction, course resale, scraping, model training, publication or creation of a competing derivative library.

You retain ownership of original writing you create. Browser-local writing is not licensed to MMIO merely because it exists inside the interface. If you deliberately send material to support, you give MMIO the limited permission needed to receive, secure, investigate and respond to that communication.

15. Consumer guarantees, disclaimers and liability

Services supplied to consumers come with guarantees that cannot be excluded under the Australian Consumer Law, including that they will be provided with due care and skill, be reasonably fit for a purpose made known in circumstances where reliance is reasonable, and be supplied within a reasonable time where no time is fixed.

Subject to those rights and to the maximum extent permitted by law:

  • general wellbeing information is provided for self-guided use and must not be treated as personalised clinical, legal, financial or safety advice;
  • we do not warrant that a tool will be appropriate for every person or produce a particular result;
  • each party remains responsible for loss caused by its own unlawful act, negligence, fraud or breach;
  • MMIO is not responsible for loss caused solely by unauthorised account sharing, disregard of a clear safety warning, use outside the stated scope, a user-controlled deletion, or an independent third-party service that MMIO did not control, except where law provides otherwise.

Nothing in these Terms excludes liability for fraud, wilful misconduct, personal injury caused by negligence where it cannot be excluded, breach of confidentiality, infringement, or any other liability that law does not allow us to exclude or limit.

Any limitation is interpreted narrowly and only to the extent it is fair, transparent and legally effective in the circumstances. These Terms do not require you to indemnify MMIO for our own negligence, breach or unlawful conduct.

16. Complaints and disputes

Please raise a concern through support@mymindisok.com and provide enough non-sensitive information for us to identify the account, transaction and issue. The Complaints and Dispute Resolution Policy explains response stages and external options.

Before court proceedings, each party should make a genuine attempt to resolve the dispute through written notice and reasonable discussion, except where urgent relief, a limitation deadline, a regulator, a chargeback right or a non-excludable consumer remedy makes that inappropriate.

17. Governing law and jurisdiction

These Terms are governed by the laws of WA and applicable Commonwealth law. The parties submit to courts and tribunals that have jurisdiction, but this clause does not prevent a consumer from relying on rights or forums available under mandatory law in their own State, Territory or country.

If one provision is invalid or unenforceable, it is read down where possible and otherwise severed without invalidating the remaining provisions. A delay in enforcing a right is not automatically a waiver.
